The formal presentation of the silver service donated by the citizens of New York, to the cruiser New York, through a subscription raised by the New York Herald, took place Wednesday last. The service which was designed and made by the Whiting Mfg. Co., is a magnificent production and consists of sixteen pieces including a punch bowl, entree and vegetable dishes, salad bowl, and dessert compotiers. The presentation speech was made by Congressman Amos J. Cummings. Capt. John W. Philip, of the New York, received the gift on behalf of the ship.

F. M. Whiting Co. Agree to Change Their Name to Frank M. Whiting & Co.

The action brought by the Whiting Mfg. Co., New York, against the F. M. Whiting Co., North Attleboro, Mass., which was tried before Judge Pryor, of the Supreme Court, last November, as published in full in The Circular at that time, has at last been settled out of court, a result of negotiations covering a period of five months.

The suit was brought by the Whiting Mfg. Co. to restrain the defendant company from using a griflin trade mark (since discontinued), and from doing business under their corporate name of F. M. Whiting Co. by the settlement just consummated, the F. M. Whiting Co. consent to an injunction against the future use of their old trade mark, but all goods containing it are free from interference by the plaintiffs. They also consent to change their name from the F. M. Whiting Co. to Frank M. Whiting & Co., and have reincorporated under the latter name in the State of Rhode Island. The defendants also agree to pay $400, about one half the disbursements paid out by the plaintiffs.

It is agreed by the Whiting Mfg. Co. that the action against F. M. Whiting Co. and the actions brought against the defendants' customers to restrain them from selling F. M. Whiting goods be discontinued.

Geo. D. Merrill, who has been for many years with the Whiting Mfg. Co., has severed his connection with that company, and has become a partner with his brother, J. M. Merrill, of J. M. Merrill & Co., Jackson Building, Union Square. The new firm, which will be known as Merrill Bros., have moved their factory from Nassau St. to 16th St., and have improved their facilities for manufacturing the finest class of silver novelties.

The Whiting Manufacturing Company, whose silver finishers to the number of 100 went on strike seven weeks ago for recognition of the union, reported yesterday it had practically broken the strike. The firm employs about 500 silversmiths, finishers, chasers and others, and only the finishers went out. The following statement was made last evening on behalf of the firm:

"We have now seventy men in the place of the strikers, who were supplied by Wadell & Mahon, strike breakers. The men proved to be proficient and are now accustomed to our methods of business, and we can get all the men we want. We anticipate not the slightest trouble and are carrying out our Christmas orders as if there had never been a strike."

Preliminary sketches of the new factory of the Whiting Mfg. Co., to be built at Bridgeport, Conn., have been prepared by F. A. Wing, the engineer of the company. Twelve different contractors have been asked to submit estimates upon the factory. Five steel and brick buildings will be constructed, with a floor space of over 75,000 feet. A boiler house and a 500 H.P. engine will be installed. The Whiting Mfg. Co., one of the largest manufacturers of sterling silver ware in the United States, are now located in New York City.

The Gorham Manufacturing Company of Providence, R. I., manufacturing silversmiths, have purchased the controlling interest in The Whiting Manufacturing Company of New York City. The Whiting Company have been one of the principal competitors of the Gorham Company, and this control will amalgamate both interests. It is reported that $800,000 was paid for the interest. Charles E. Bulkley, the president of the Whiting Company and Fred. S. Salisbury, the treasurer, will retire.

Former Secretary of the Whiting Mfg. Passes Away at Pawling, N. Y.

An old and formerly well known member of the silverware trade passed away Wednesday, when Wyllys E. Dowd, formerly of the Whiting Mfg. Co., died of heart disease at Pawling, N. Y.

Mr. Dowd was a native of Connecticut and was born 64 years ago. He was the son of Dr. Charles Dowd, a noted educator, and head of a seminary at Saratoga Springs, N. Y., who gained fame throughout the country as the man who originated the system of standard time which was later adopted by the railroad companies of the country.

As a young man, Mr. Wyllys Dowd entered the silver business and became connected with the Whiting Mfg. Co. during the time that Charles E. Bulkley was the president of the concern. Mr. Dowd became a director, and for a number of years secretary of the concern, while it was located on Broadway, in the vicinity of Union Sq. where he retired from the company just before the control was taken over by the Silversmiths Co.

In 1877 he married Miss Francis I. Cheseborough of New York. He is survived by his widow and by one son, Wyllys E. Dowd, Jr.

The indictments found in New York city against George W. Scheibler, the Whiting Manufacturing Company, Theodore B. Starr, the Gorham Manufacturing Company, Thomas Kirkpatrick, John Daniell & Sons, Bloomingdale Bros., Robert C. Black, Aaron B. Frost, and Frank M. Whiting, have been dismissed. The indictments were filed March 24, 1896, charging violation of section 364A of the Penal Code in stamping certain silverware with the word "sterling" when it was alleged that the silverware did not come up to the required standard. Assistant District-Attorney Welch, in speaking of the cases, said:

"These indictments should never have been found; the charges were frivolous ones, and the result of a row between the jewelers of New York and the proprietors of the department stores."
