ONTARIO SILVER Co.

Ontario Silver Co. Convicted of Falsely Marking Its Stock and Fined $600

Toronto, Ont., June 20. — The charges against the Ontario Silver Co., Niagara halls, for the fraudulent use of the word “Sheffield” and other trade-marks on their goods, and against George W. Clark, manager of the company for conspiracy to defraud the public, came up for trial before Judge Wells at Welland, June 16. The case against the manager was withdrawn. Four separate indictments were laid against the company.

No defence was made, but J. W. Nesbitt, K. C., of Hamilton, who appeared for them, pleaded for leniency, placing the blame on the former owners of the business. The judge inflicted a fine of $150 on each count — in all, $600.

In pronouncing sentence, Judge Wells spoke very strongly in condemnation of the conduct of the company, comparing it to the issue of counterfeit money by a chartered bank. He expressed the opinion that the law in such cases should be altered to conform to that prevailing in some of the States of the Union, where officials of companies countenancing illegal acts such as those of which the defendants were guilty can be punished by imprisonment. In Canada no punishment other than a fine can be inflicted in such cases.
