BUGBEE & NILES CO. ANSWERS
Providence Concern Files Reply to Complaint of Dubois Watch Case Co. Alleging Infringement of Patent on Wrist Watch Bracelets.
An answer to the action started last month by the Dubois Watch Case Co., New York, against the Bugbee & Niles Co., manufacturing jewelers, Providence, R. I., was filed in the United States District Court last Friday. The action the alleged infringing of reissue Letters Patent involves on bracelets for wrist watches.
The defendant in its answer denies that it has infringed the reissue patent No. 13,951 in suit. A resumé of the reply to the bill of complaint makes a general denial of every allegation made by the complainant.
The defendant concern admits that the original patent No. 1,113885 was issued on Oct. 13, 1915. The answer denies that reissue patent letters No. 15,951 issued July 27 last is for the same invention as for which the original patent was granted. That the original patent was granted. That the reissue patent in suit broadens an extends the original patent, so as to include within the scope of the reissue patent structures not in the original invention, is the answer made by the defendant.
The answer also denies that the defendant is making, using or selling any embodiment of any invention patented in the reissue patent in suit, and also denies that the complainant has been deprived wrongly of profits. The defendant avers the alleged inventors named in the suit were not the original inventors of any material or substantial part of this patent, but alleges that this article was Invented by others.
In closing the defendant claims that it is ready to maintain all its denials and prays that the case be dismissed with reasonable costs and charges.
